Was a search by Auburn Police legal? That was the question at the center of the suppression hearing Friday in Cayuga County Court.
According to the Citizen, 61-year-old Mary Ferro, the romantic partner of murder suspect 26-year-old Gage Ashley, claimed she did not give consent to the search of her home.
Ashley is one of four people accused in the November 2019 shooting death of Joshua Poole in Auburn. Ashley was convicted of the murder, but the conviction was overturned on a technicality.
Judge Thomas Leone expects to issue a decision by February 2nd. Ashley’s second trial is scheduled to start in March.
