Auburn Man Arraigned Again After Murder Conviction Overturned

The man accused of the 2019 killing of an Auburn resident Joshua Poole has been arraigned again after having his previous murder conviction overturned.

The Citizen reports 25-year old Gage Ashley was in court Thursday for two murder charges along with attempted robbery and criminal possession of a weapon charges related to killing of Poole at his 8 Delevan Street home during a robbery gone wrong.

Ashley was previously sentenced in December of 2021 after being convicted; however, a May decision by an appeals court decided the grand jury that indicted him was invalid as one of the jurors was unable to serve because he was a convicted felon.

The conviction was then overturned without prejudice, allowing the District Attorney’s Office to go before a different grand jury.

Lucciano Spagnola and Tyree Anglin were also convicted for their roles in murder. Their convictions have not been affected by the appeals court’s decision as of yet.

If convicted, Ashley faces up to life in prison.
