2nd Man Seeks to Have Auburn Murder Conviction Overturned


Another one of the trio accused of killing an Auburn man during a 2019 botched burglary is seeking to have his conviction overturned.

Lucciano Spagnola pled guilty to two counts of murder, one count of attempted robbery, and conspiracy in 2021 for his role in the death of Joshua Poole at his 8 Delevan Street home. Spagnola admitted to firing a shotgun at Poole, intentionally killing him.

Speaking with The Citizen, attorney Ben Susman said he filed a motion last month to have Spagnola’s conviction overturned due to an issue with the grand jury that indicted him.

Back in May, Gage Ashley had his conviction overturned by a state appeals court after it was found that a member of the grand jury was ineligible to serve on it due to a prior felony conviction.

A third person, Tyree Anglin, pled guilty to manslaughter for his role in the murder.
