Geneva Town Board OKs Tax Cap Override for Sewer, Water

The Town of Geneva has approved a resolution addressing tax levies for its special districts, a routine step officials say ensures the town remains compliant with New York’s tax cap law.

Town Supervisor Mark Venuti said the measure mirrors the annual process used for the town’s general fund, but also extends to a range of special districts, including sewer, water, and other service areas.

“We have to cover both the general fund and all the special districts,” Venuti said. “That includes our sewer district and the many water districts and sub-districts. They all have their own budgets, and they all fall under the tax cap law.”

Under state law, municipalities are generally limited in how much they can increase property taxes each year. To maintain flexibility, the Town Board adopts a resolution annually—on the advice of the town attorney—that allows it to override the tax cap if necessary.

Venuti emphasized that the resolution does not automatically raise taxes, but instead preserves the town’s ability to do so if budget conditions require it.

The process is expected to remain in place for the foreseeable future.

“Not until they repeal the tax cap law,” Venuti said, when asked if there could be a time when such procedural votes are no longer needed.

Town officials say the resolution is a standard part of budget planning, ensuring all districts are accounted for while maintaining compliance with state requirements.
