On Tuesday, Ontario County Sheriff’s Deputies arrested two individuals following a larceny investigation at the Kohl’s department store on Commerce Drive in Victor.

Authorities arrested 36-year-old Thomas Fathergill Jr. and 58-year-old Kathleen Creswell, both residents of Canandaigua, at approximately 2:20 p.m. Deputies allegedly recovered $58.98 worth of merchandise from Fathergill and $1,579.88 worth of merchandise from Creswell.

Fathergill was charged with Petit Larceny, while Creswell was charged with Grand Larceny in the Fourth Degree. Both defendants were released on appearance tickets and are scheduled to answer the charges in Victor Town Court at a later date.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
