A Penn Yan man was arrested following a reported violation of an order of protection.
Police say 72-year-old James Gerard was taken into custody after officers responded to a complaint and found him inside the residence of an individual who has an active stay-away order of protection against him.
Gerard was transported to the Penn Yan Police Department for processing and later released on an appearance ticket.
He has been charged with Criminal Contempt in the Second Degree and is scheduled to appear in Penn Yan Village Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
