A Savona man is facing serious felony charges after state police say he illegally used a handgun to kill an injured deer in Steuben County.
New York State Police say 42-year-old James Labarr, of Savona, was arrested following a Bureau of Criminal Investigation probe into the incident. It dates back to the evening of November 3, when troopers were called to State Route 226 in the town of Bath for a report of an injured deer along the roadway.
During that response, investigators learned that a man had allegedly fired a handgun to kill the deer and then left the scene. Further investigation determined Labarr, who police say is a convicted felon, had a loaded handgun and discharged it during the incident. The firearm was later recovered and secured as evidence.
State Police located Labarr at his home last Friday, where he was taken into custody without incident.
Labarr is charged with criminal possession of a weapon in the second degree, a C felony, and criminal possession of a weapon in the third degree, a D felony. He was processed at State Police Barracks in Bath and taken to the Steuben County Jail for centralized arraignment.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
