Two survivors of last month’s deadly tour bus crash on the New York State Thruway in Genesee County are suing the operator, alleging negligence led to the tragedy.
According to WIBW-TV in Buffalo, the lawsuit, filed in Queens County State Supreme Court, names M&Y Tour, Inc. and the driver, Bin Shao, as defendants. Plaintiffs Mohammed Rahman and Zakir Hossain accuse the company of operating the bus in a “negligent, reckless, and careless” manner.
According to the complaint, the bus was speeding, lacked proper brakes and steering mechanisms, and was under the control of an unfit and inexperienced driver. Police investigators said distraction appeared to be the cause of the crash, and impairment was ruled out.
The crash happened on August 22 as the bus was returning to New York City from Niagara Falls. Authorities say the bus veered into the median near Pembroke, overturned into a ditch, and left a devastating toll: five dead, more than four dozen injured, and all 54 passengers sustaining some type of injury. Many were thrown from the bus because they were not wearing seat belts.
The lawsuit seeks damages for the injuries suffered by Rahman and Hossain.
