A Penn Yan attorney has been indicted on rape charges stemming from an alleged incident last fall.
A Yates County Grand Jury charged Thomas Plan with first-degree rape, a Class B violent felony, and third-degree rape, a Class E felony. Prosecutors allege that in September 2024, the 30-year-old Plan forcibly engaged in sexual intercourse with another person and also had sexual intercourse without consent.
Plan turned himself in on Friday on a warrant from the sealed indictment. The document was unsealed during his arraignment in Yates County Court, where he appeared with his attorney before Seneca County Court Judge Barry L. Porsch, who will preside over the case.
Plan pleaded not guilty to all charges and was sent to Yates County Jail in lieu of $10,000 bail. As a green card holder and citizen of the United Kingdom and Germany, he was also ordered to surrender his passport.
Steuben County District Attorney Brooks Baker has been appointed special prosecutor. The case is scheduled to return to court on October 14 for the filing and argument of defense motions.
According to his website, Plan represented clients in criminal accusations, regulatory law, immigration law, and civil litigation. He has an office on Liberty Street in the Yates County village.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
