A 52-year-old Penn Yan man is facing additional charges after resisting arrest in the Yates County village.
Police say Tino Rivas was spotted walking on East Elm Street and was known to be wanted on an active warrant issued by the Yates County Sheriff’s Office. When officers attempted to take him into custody, Rivas allegedly resisted.
He was eventually taken into custody and transported to the Penn Yan Police Department, where he was turned over to the Sheriff’s Office. In addition to the original warrant, Rivas was charged by Penn Yan Police with resisting arrest and later arraigned in Yates County CAP Court.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
