As previously planned, Emerson Tohafjian will go on trial at the beginning of December for allegedly killing his ex-girlfriend and her friend last July.
Acting Seneca County Judge Rick Healy ruled this week the grand jury indictment charging Tohafjian with two-counts of first-degree murder will stand. Tohafjian’s attorney requested Judge Healy inspect the grand jury minutes and asked the judge to dismiss or reduce some of the counts during last week’s pre-trial motions. The Waterloo man also faces charges of criminal use of a firearm, intimidating a victim or witness, burglary, criminal contempt and assault.
Tohafjian remains jailed without bail.
