A 47-year-old Penn Yan man was arrested for DWI after village police were alerted by staff at the Gulf Station on Liberty Street of a man that was passed out in the driver’s seat of his car.
Officers spent several minutes attempting to wake Arthur Smith and placed him through field sobriety tests, which he failed. Smith was taken to Yates County Jail for a chemical breath test, which he refused. He was charged with felony drunken driving due to a previous DWI conviction in the town of Torrey and two similar convictions in North Carolina.
Smith was sent to Yates County Jail following his arraignment.
