An Ontario County jury deliberated about three hours before convicting a Geneva man who broke another man’s arm with a steel rod last summer.
Braolio Jesus Vargas was found guilty of first-degree attempted assault following a four-day trial in county court. The charge is a class C felony punishable by up to 15 years in prison.
Vargas was acquitted of first-degree assault, a class B felony, punishable by up to 25 years in prison.
Judge William Kocher will sentence Vargas June 12.
County Assistant District Attorney Jim Ritts prosecuted the case. He said due to Vargas’ criminal history, the minimum sentence will be five years.
