Monday afternoon in Seneca County Court 54 year old John Smith of Burgess Road Waterloo pled guilty to leaving the scene a fatal motor vehicle accident in the May 21st hit and run that killed Stephen Hilyer the second. The accident happened around 12:15 am on Routes 5 and 20 between Brewer and Packwood Roads.

County Judge Dennis Bender will sentence Smith on January 7th to from 1 and a half to 4 and a half years in prison . Maximum penalty would have been 7 years.
Smith had a history of drunk driving arrests.
Hilyer's family is working on legislation with State Senator Mike Nozzolio that would strip serial DWI offenders of their licenses. Nozzolio says this would make permanent an executuive order from Governor Cuomo.
