An Auburn man will get another chance at staying on the good side of the law. A judge called David Janus a victim of circumstance. Janus faced as much as three years in prison for selling methadone when he appeared in Cayuga County Court Thursday morning.
The 34 year old Janus says he sold the drug to save the life of his wife, who was addicted and might have died from withdrawal. Judge Thomas Leone said Janus isn't an addict and didn't have much of a criminal history, so he gave him a second chance.
However, Janus didn't escape punishment fully -- the judge sentenced him to five years of probation for the two 4th degree felony drug selling charges on which he was convicted, with one week in county jail.
