Appeal Filed Against Ruling Dismissing Tyre Casino Lawsuit

As promised Geneva Attorney Mario Fratto has filed an appeal of Judge Patrick Falvey ruling dismissing the lawsuit Fratto brought on behalf of 57 Town of Tyre residents trying to halt plans for a casino in their back yard.
The lawsuit seeks to overturn a Planned Unit Development law that would ease the way for a casino, resort, hotel and spa project proposed by the Wilmorite Corporation on 85 acres of land just north of the Waterloo Thruway Exit.
Fratto says the Judge was not clear in how he reached his decision.
Fratto says the Judge also was erred when he ruled that the Town Website could be used to supplement the public notice process.
Fratto says he can't tell yet when the appeal would be heard.
In a written statement the group Casino Free Trye said "Tyre is not a community in which a casino should be sited and forced upon the vulnerable people of this beautiful rural, agricultural and religious area. "
