The family of Kevin Ward, Junior, and former NASCAR star Tony Stewart will have to appear in a Utica courtroom Thursday to discuss their lawsuit settlement.
Judge David Hurd scheduled a hearing for Thursday after it was announced earlier this month both sides in the lawsuit had reached an agreement. Earlier this week, lawyers for Ward’s family and Stewart asked the judge to cancel Thursday’s hearing because they had privately settled and the law doesn’t require a judge to approve the suit. In his court filing Wednesday, Judge Hurd wrote he needs to determine if a binding agreement has been reached and agree to dismiss the case. No information regarding the settlement will be revealed.
Thursday’s court hearing is scheduled for 2 p.m.
