ESPN is reporting the parents of Kevin Ward, Junior and Tony Stewart have reached a settlement in a wrongful-death lawsuit filed against the former NASCAR star. The settlement comes just a month before the two sides were to go to trial.
Kevin Ward Jr. was killed after Stewart hit him with his car during a race at Canandaigua Motorsports Park in 2014. Ward got out of his car and started to walk towards Stewart’s racer. Toxicology reports show Ward also had marijuana in his system.
An Ontario County grand jury cleared Stewart of wrongdoing. Ward’s parents filed a wrongful death lawsuit in 2015. Stewart later filed a motion claiming he did not have time to react.
A hearing on the settlement will be held April 12th.
