An Auburn man is in the Cayuga County Jail charged with assaulting an Auburn Police officer on Friday night.
Police were called to a reported domestic disturbance at 123 Wall Street, where they spoke with Justin Gervais and other occupants of the residence. The officers left the scene but were called back later when Gervais was allegedly banging on a neighbor’s door, accusing the neighbors of calling the police.
After initially refusing to come out of his apartment, Gervais is alleged to have left the apartment and walked down a staircase, where he was confronted by Officer Morgan Flickner. Gervais attempted to push the officer down the stairs before grabbing her by the hair and slamming her head into the top of the stairs. He then got on top of the officer and punched her several times in the head.
Officer Flickner was able to escape from Gervais, who tried to run back into his apartment. The officer had a grasp on his shirt, and attempted to use her taser to subdue Gervais; however, full contact was not made. Officer Flickner then used her pepper spray and was able to take Gervais into custody.
Officer Flickner was taken to Auburn Community Hospital, where she was diagnosed with a concussion and treated for facial injuries.
Gervais is charged with assaulting a police officer and resisting arrest as well as a noise violation contrary to a city ordinance.
