A state appellate court has found Ontario County District Attorney-elect Jim Ritts guilty of prosecutorial misconduct.
According to FingerLakes1.com, the November 9th decision by the 4th Department Appellate Division found Ritts guilty in the case involving Braolio Vargas. He was convicted of first-degree attempted assault, but the court agreed Ritts improperly used Vargas’ nickname, “Diablo.”
The Appellate division upheld the conviction, finding the misconduct was not so egregious as to deny defendant a fair trial.
Ritts says it won’t happen again.
